Settlement Reached in "Pickles" the Steer Dispute

Pursuant to a settlement agreement reached between the parties this week, Jenna, Bryan and Lisa Sievers today asked the Polk County District Court to dismiss their petition for judicial review of the Iowa State Fair Board's decision to disqualify their steer, "Pickles," from the Iowa State Fair 2002 4-H market steer exhibition.
The steer was disqualified on August 16, 2002. In October 2003 a contested case hearing was conducted on the issue by an administrative law judge, who issued a proposed decision in November 2003 reversing the disqualification by the Fair. On February 20, 2004, the Iowa State Fair Board issued a final decision reversing the administrative law judge's decision and affirming the original finding disqualifying the Sievers steer from the 2002 State Fair. In April 2004 the Sievers filed a petition for judicial review by the Polk County District Court.
According to a Settlement Agreement and Consent Order presented to the Court today, "The parties maintain their respective positions but wish to bring this matter to a conclusion."
The dismissal means that the Fair's decision to disqualify "steer number 227" stands.
Under the settlement agreement between the Sievers and the State Fair Board: The Sievers dismiss the appeal pending in Polk County District Court; any premium money collected from the sale of steer number 227 will be donated to the Iowa Foundation for Agricultural Advancement; the championship banner and trophy will be donated to the Iowa State Historical Society; and Iowa State University will be authorized to dispose of the carcass of the steer.
